Online Course Terms and Conditions
1. Online Course Provider
1.1 The Online Courses are provided by Rooted Learning.
1.2 Rooted Learning will use its best efforts to provide the Online Courses as advertised.
1.3 We commit to providing the Online Courses with due care and skill.
1.4 We may engage independent sub-contractors or third parties to assist in delivering certain aspects of the Online Courses. By using our services, you agree that we will exercise reasonable care in selecting competent sub-contractors and third-party suppliers. Rooted Learning is not liable for the actions or omissions of such sub-contractors or third-party suppliers.


2. Definitions
2.1 Capitalized terms used herein (and not otherwise defined) have the following meanings:
•    "Additional Study Materials" refer to any Online Study Materials or Physical Study Materials not included in the Course Fee.
•    "Additional Online Terms and Conditions" denote any additional terms and conditions related to an Online Course, agreed upon in writing by Rooted Learning with a particular student.
•    "Brochure" encompasses any online or hard copy material produced by Rooted Learning providing detailed information about the Online Courses.
•    "Course Fee" means the fee payable for an Online Course, excluding delivery charges, if applicable, and any import duties, taxes, and customs clearances.
•    "Course Materials" comprises materials provided by Rooted Learning during the Online Course, which may be in the form of Online Study Materials and/or Physical Study Materials.
•    "On Demand Online Course" signifies an online course without a predetermined start date, available for immediate study.
•    "Online Course" denotes either an On-Demand Online Course or a Scheduled Online Course provided by Rooted Learning.
•    "Online Study Materials" include electronic materials available for download from the Website or accessible and viewable on the Website, including but not limited to PDFs, MP3s, JPEGs, MPEG4s, and MOVs.
•    "Physical Study Materials" represent materials in physical formats, including but not limited to DVDs, CD-ROMs, Blu-rays, and Audio CDs.
•    "Scheduled Online Course" is an online course accessible only on a predetermined start date.
•    "Terms and Conditions of Website Use" refers to the terms and conditions for accessing the Website, which can be found [here].
•    "Website" is defined as www.onlinebushcraftcourses.com or any other domain operated by Rooted Learning.
•    "You" refers to the individual purchasing the Online Course.
2.2 The use of singular words herein also includes the plural.


3. Purchasing and Confirmation
3.1 To purchase an Online Course, you must provide complete and accurate information and pay the specified amount.
3.2 Placing an order for an Online Course constitutes an offer to purchase that course under the Online Terms.
3.3 A legally binding agreement is established when: (a) Rooted Learning accepts your offer by sending you an order confirmation email containing a link to access the Online Course, along with login details (if applicable); and (b) Rooted Learning receives the entire Course Fee in cleared funds from you (or on your behalf).
3.4 The Online Terms, along with your purchase offer and the order confirmation email, constitute the entire Contract, superseding any prior terms and conditions or understandings. You acknowledge not relying on any representations or statements not set out in the Contract.
3.5 You must review the order confirmation email for accuracy upon receipt. Contact us immediately at info@rootedlearning.co.uk in case of errors.
3.6 If your order includes multiple Online Courses, each is treated as a separate offer. Acceptance of one Online Course offer does not imply acceptance of others in your order.
3.7 We reserve the right to refuse any offer to purchase Rooted Learning Online Courses without providing a reason. In such cases, no contract will be formed, and any payment will be returned.
3.8 Before a Contract is established, we may change the advertised Course Fee for an Online Course or amend course information. We also reserve the right to withdraw Online Courses from sale at any time.


4. Payment


4.1 The Course Fee for an Online Course, along with any additional delivery charges for Course Materials, if applicable, will be displayed on the Website and other marketing materials. Offers and discounts are subject to specific dates, prices, and times stated.
4.2 All payments are to be made in Pounds Sterling, inclusive of VAT. Currency conversion costs and other charges are your responsibility and not deductible from amounts due to Rooted Learning.
4.3 Unless otherwise specified, the Course Fee can be paid: (a) in a one-off lump-sum payment with your purchase offer; or (b) if offered, in installments, with payments due at specified times over a set period, as detailed on the Website and/or in a Brochure and/or as notified by Rooted Learning.
4.4 By selecting the installment option per Clause 4.3(b), you agree to: (a) Ensure timely installment payments. (b) Authorize Rooted Learning and/or its service providers to collect installments from your debit/credit card. (c) Notify us at info@rootedlearning.co.uk if your debit/credit card changes or expires. (d) Understand that failure to make an installment payment as scheduled constitutes a breach of contract. This may result in loss of the right to pay by installments and suspension or cancellation of access to the Online Course until all installment amounts are paid. (e) Accept that, subject to Clause 5.2, Rooted Learning will not refund any payments made if action is taken under Clause 4.4(d)(ii). (f) Know that if you cancel your order per Clause 5.1 or Clause 5.2, you won't be entitled to a refund, and course access won't be available until all payments are made. Failure to complete payments by the course completion date may result in course termination.
4.5 The installment payment option is subject to availability. Rooted Learning may withdraw this option at any time without affecting customers already enrolled and paying by installments.
4.6 The total payment for an Online Course may vary depending on lump-sum or installment payment options.
4.7 Payments for the Course Fee can be made by: (a) PayPal; (b) credit card (Visa, MasterCard, American Express) or debit card (Visa Electron, Delta, Maestro); or (c) bank transfer, to be arranged directly with us (contact details at http://frontierbushcraft.com/contact-us/ or info@rootedlearning.co.uk).
4.8 In case your purchase offer is accepted with an incorrect Course Fee on the Website or in any Brochure, Rooted Learning will notify you. If the correct Course Fee is higher, you can decide whether to proceed with the order at the increased Course Fee or cancel it for a full refund of any amount paid. If the correct Course Fee is lower, we will refund the difference.


5. Cancellation and Refunds


5.1 Once purchased the course is non-refundable. 


6. Access to Online Courses


6.1 Upon acceptance of your purchase offer, we will provide you with access to the Online Course materials. Access details and instructions will be sent to the email address provided by you during the purchase process. It is your responsibility to ensure the accuracy of this information.
6.2 You must not share your login details with any other person. Each Online Course is sold to a single user for personal use only. Unauthorized sharing of access credentials may result in immediate suspension of access to the Online Course, with no entitlement to a refund. Legal action may also be taken.

6.3 The customer will have to provide Rooted Learning with a Google Email address. The customer will have to be able to access Google Classroom to be able to access the course. Rooted Learning does not take any responsibility for the learner not being able to access Google Classroom. 
6.4 Rooted Learning reserves the right to suspend access to any Online Course at its discretion, including but not limited to the following circumstances: (a) You breach any terms and conditions. (b) Technical issues prevent access. (c) Security issues arise. (d) Rooted Learning cancels your order under Clause 5.6. (e) You have outstanding payments per Clause 4.4(b).
6.5 In case your access to an Online Course is suspended for reasons other than a breach of contract, we will work to restore access as soon as reasonably possible.


7. Course Materials


7.1 Rooted Learning provides Course Materials as part of the Online Course
7.2 All Course Materials, including Online Study Materials and Physical Study Materials, are owned by Rooted Learning or its licensors and are protected by intellectual property laws. You must not: (a) Copy, modify, or distribute Course Materials without our prior written consent. (b) Use Course Materials for any commercial purpose or personal gain. (c) Share Course Materials with unauthorized users. (d) Attempt to remove, alter, or circumvent any security or digital rights management features from Course Materials. (e) Infringe on any intellectual property rights in Course Materials.
7.3 You are solely responsible for ensuring that you have the necessary technical equipment, including software and hardware, to access and use the Course Materials. Rooted Learning is not responsible for any technical issues that prevent you from accessing or using the Course Materials.


8. Accuracy and Changes


8.1 Rooted Learning takes reasonable care to ensure the accuracy of information provided in the online course, on the Website, and in other marketing materials. However, Course Materials may be subject to changes, updates, or corrections without notice. At times there maybe slight spelling and grammar mistakes, which Rooted Learning will change as soon as it becomes aware of such errors.
8.2 Rooted Learning reserves the right to make changes to the content, format, or structure of an Online Course or to discontinue an Online Course altogether. In such cases, we will notify affected students and make reasonable efforts to provide alternative options, such as enrolment in a similar course. If Rooted Learning does discontinue any course it will fully refund any persons effected.


9. Student Responsibilities


9.1 You are responsible for: (a) Ensuring that you meet the course prerequisites, if any. (b) Providing accurate information during the purchase process. (c) Maintaining your account details and promptly updating any changes, including your email address. (d) Using Course Materials responsibly, following the guidelines set out in Clause 7. (e) Respecting the intellectual property rights of Rooted Learning and its licensors, as detailed in Clause 7. (f) Complying with all applicable laws and regulations while using the Online Course and Course Materials. (g) Providing accurate and honest feedback in any evaluations or surveys conducted by Rooted Learning.


10. Technical Requirements


10.1 You are responsible for ensuring that you have the necessary technical equipment, including internet access, software, and hardware, to access and use the Online Course and Course Materials. Rooted Learning does not provide technical support for personal devices or software.
10.2 While we strive to ensure the availability and functionality of the Online Course and Course Materials, we do not guarantee uninterrupted access or the absence of technical issues.


11. Confidentiality and Data Protection


11.1 Rooted Learning is committed to protecting your personal information. Our Privacy Policy outlines how we collect, use, and protect your data. By using our services, you consent to the collection and use of your data as described in the Privacy Policy.
11.2 You agree not to disclose or share any confidential or proprietary information provided to you during the Online Course, including but not limited to Course Materials and any discussions or forums, with third parties.
11.3 You may be required to create a username and password to access the Online Course. You are responsible for keeping this information confidential and for any activities that occur under your account.


12. Termination


12.1 Rooted Learning may terminate the Contract and suspend your access to the Online Course at its discretion, including but not limited to the following circumstances: (a) Breach of any terms and conditions herein. (b) Technical issues prevent access. (c) Security issues arise. (d) You have outstanding payments per Clause 4.4(b). (e) You violate any applicable laws or regulations.
12.2 In case of termination due to a breach of contract, you will not be entitled to a refund, and access to the Online Course will cease immediately.


13. Complaints and Disputes


13.1 If you have any complaints or disputes regarding the Online Course, please contact us at info@rootedlearning.co.uk. We will aim to resolve any issues promptly and fairly.

14. Miscellaneous


14.1 The Contract, including these Terms and Conditions and any other documents referenced herein, constitute the entire agreement between you and Rooted Learning. Any prior agreements, understandings, or representations are superseded by this Contract.
14.2 Any failure by Rooted Learning to enforce any of its rights or provisions under this Contract shall not be considered a waiver of such rights or provisions.
14.3 If any part of these Terms and Conditions is found to be invalid or unenforceable, it shall be amended to the minimum extent necessary to make it valid and enforceable, and the rest of the Contract shall remain in full force and effect.
14.4 Rooted Learning may assign or transfer this Contract, in whole or in part, to any third party without your consent. You may not assign or transfer your rights or obligations under this Contract to any other person or entity without our prior written consent.


15. Governing Law


15.1 This Contract shall be governed by and construed in accordance with the laws of England and Wales.

By confirming your purchase and accessing the Online Course, you acknowledge that you have read, understood, and agreed to these Terms and Conditions.
